Who you are buying from

This website, music.ercolano.it, is operated by Art Decor Suites S.r.l., a company incorporated under Italian law, with registered office at Via Angelo Cosenza 90, 80062 Meta (NA), Italy — VAT and tax number 10361701211, registered with the Naples Company Register under REA no. NA–1100105, share capital €25,000 fully paid up. Certified email (PEC): gierc@pec.artdecorsuites.com.

Ercolano Music is the trading name under which Art Decor Suites S.r.l. sells its handcrafted Sorrento music boxes. In these Terms, "we", "us" and "our" refer to Art Decor Suites S.r.l., the seller and party to every contract concluded through this website. For any question you can write to us at info@ercolano.it.

Scope and acceptance

These Terms & Conditions govern the sale of products offered on music.ercolano.it and form a distance contract under the Italian Consumer Code (Legislative Decree 206/2005) and, where applicable, EU consumer law. By placing an order you confirm that you have read and accepted these Terms. We recommend saving or printing a copy for your records.

If you are purchasing in the course of a business, trade or profession, you act as a professional buyer and certain consumer protections described below (in particular the right of withdrawal) do not apply to you.

Our products

Every music box we sell is handmade in our workshop in Sorrento. Because each piece is worked by hand, small natural variations in grain, marquetry, colour and finish are part of the craft and are not defects. Product photographs are as faithful as possible, but your screen may render colours slightly differently from the finished object.

The melody of each music box may vary by availability. Where a specific tune is not guaranteed, this is stated on the product page. Dimensions and materials are shown in the product details.

Prices

All prices are shown in euro (€) and include Italian VAT where applicable. Prices do not include shipping, which is calculated separately at checkout based on the destination and the value of the order. We reserve the right to change prices at any time; the price that applies to your order is the one displayed at the moment you place it.

For deliveries outside the European Union, any customs duties, import taxes or clearance fees are set by the destination country and are payable by the customer. These charges are not included in our prices or shipping costs.

Placing an order

To place an order, add the items you wish to buy to your cart and follow the checkout steps. Before confirming, you will see a summary of your order, the total price and the shipping cost. Submitting the order by selecting the payment button constitutes a binding offer to purchase.

The contract is concluded when we send you an order confirmation by email. If we are unable to accept or fulfil your order — for example, if an item is no longer available — we will inform you promptly and refund any amount already paid, without further liability.

Payment

We accept payment by credit and debit card (including Apple Pay and Google Pay) through our secure payment provider, and by PayPal. Payment is processed at the time the order is placed. We do not store your full card details; these are handled directly by the payment provider under their own security standards.

Shipping and delivery

We ship worldwide. Shipping is free within the European Union. For all other destinations, the shipping cost is calculated at checkout based on the destination and the value of the order, and shown to you before you pay. As a guide, we dispatch within 2 working days of payment, with delivery of approximately 4 working days within Italy and 10 working days abroad, subject to the courier and customs. Every music box is wrapped by hand and double-boxed for protection. You will receive a tracking link by email as soon as your parcel is on its way.

Your right of withdrawal

If you are a consumer, you have the right to withdraw from your purchase within 14 days of receiving the goods, without giving any reason, in accordance with Articles 52 and following of the Italian Consumer Code. To exercise this right, notify us within the 14-day period by writing to info@ercolano.it, stating your order number and clearly expressing your decision to withdraw.

After informing us, you must return the goods within 14 days. The items must be returned complete and in their original condition and packaging. The direct cost of returning the goods is borne by the customer. You are responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature and characteristics.

Refunds

Once your withdrawal is valid, we will refund the amount you paid for the returned goods, including the standard outbound delivery cost, using the same payment method you used for the order, within 14 days. We may withhold the refund until we have received the goods back or you have provided proof of return, whichever is earlier.

Legal guarantee of conformity

As a consumer, you are entitled to the statutory legal guarantee of conformity, which covers defects that become apparent within 2 years of delivery, under Articles 128 and following of the Italian Consumer Code. If a product is faulty or not as described, contact us at info@ercolano.it and we will arrange repair, replacement or refund as provided by law. This guarantee is in addition to, and does not limit, your rights under applicable consumer law.

Our liability

We take great care in making and describing our products, but to the extent permitted by law we are not liable for indirect or unforeseeable losses. Nothing in these Terms excludes or limits our liability where it cannot lawfully be excluded, including liability for our own fraud or gross negligence, or any statutory rights you have as a consumer.

Intellectual property

All content on this website — including text, photographs, graphics, logos, the Ercolano Music name and the designs of our music boxes — is owned by or licensed to Art Decor Suites S.r.l. and is protected by intellectual property law. You may not reproduce, distribute or use it for commercial purposes without our prior written consent.

Your personal data

We process your personal data in accordance with the GDPR (Regulation EU 2016/679) and applicable Italian law. Details of how we collect, use and protect your data are set out in our Privacy Policy and Cookie Policy.

Complaints and dispute resolution

If something is not right, please contact us first at info@ercolano.it — most issues are resolved quickly and directly. If we cannot reach a solution together, you may, as a consumer resident in the EU, turn to an approved alternative dispute resolution (ADR) body. The former EU Online Dispute Resolution platform was discontinued on 20 July 2025 and is no longer available.

Governing law and jurisdiction

These Terms are governed by Italian law. If you are a consumer, the mandatory consumer-protection provisions of your country of residence within the EU continue to apply, and the competent court is that of your place of residence or domicile. If you purchase as a professional buyer, the courts of Torre Annunziata (NA), Italy have exclusive jurisdiction over any dispute arising from these Terms.

Changes to these Terms

We may update these Terms from time to time. The version that applies to your order is the one published on this website at the moment you place it. Any changes take effect once published here.
